Lawyer: Satellite providers want fairness

COLUMBUS, Ohio (AP) – The attorney representing satellite TV providers in a fight over a 2003 state sales tax tells the Ohio Supreme Court the industry isn't looking for a refund.

The sales tax in question wasn't applied to their cable competitors.

During oral arguments Wednesday, E. Joshua Rosenkranz says the case brought by DirecTV and EchoStar Satellite Corp. isn't about getting back the more than $300 million Ohio has collected from satellite providers since imposing the 5.5 percent tax.

He says it's about leveling the future playing field between satellite and cable in the state.

The state's attorney, Larry Pratt, says the tax doesn't violate the Interstate Commerce Clause as satellite providers argue.

Similar cases in Kentucky and North Carolina have ended in state victories.
