EchoStar, TiVo trade barbs on DVR patents
EchoStar kicked it off Wednesday, announcing that the U.S. Patent and Trademark Office recently rejected "many" TiVo patent claims as invalid.
TiVo, in a release of its own, accused EchoStar of issuing "misleading spin" on the subject. TiVo said the USPTO re-examined all 61 claims, and "confirmed the validity" of most of them, including two that "EchoStar has been found to have willfully infringed."
Last month, a federal jury in Texas awarded $73.9 million to TiVo, ruling that EchoStar infringed on TiVo "time warp" patents linked to DVR technology.
Although some TiVo claims were rejected by the USPTO, TiVo said that "should in no way impact the jury verdict."
EchoStar is in the process of responding to an injunction motion filed by TiVo following the recent Texas jury verdict.
