Court moves ahead on TiVo-EchoStar DVR spat
A federal court has denied motions by EchoStar Communications Corp. to dismiss digital video recorder (DVR) patent infringement claims by TiVo Inc.
On Wednesday, the federal district court for the Eastern District of Texas, Marshall Division denied EchoStar's wish to dismiss and transfer a case in which TiVo has alleged that the DBS service provider and "certain subsidiaries" have violated TiVo's "Time Warp" patent (No. 6,233,389).
The patent explains several significant DVR functions, including a method for recording one program while playing back another, watching a show as it is recording, and trick-play functions (pause, rewind, fast-forward, slow motion, etc.) for live television.
Jury selection for the case is scheduled to begin Oct. 4, 2005. EchoStar had sought to move the case out of Texas.
