DirecTV sues NDS

DirecTV is looking to haul NDS Limited into court again. The latest: the satellite provider has filed a lawsuit against NDS charging breach of contract, fraud and misappropriation of trade secrets, among other things. NDS plans to file counterclaims.

The suit, filed under seal in the U.S. District Court in Lost Angeles Sept. 6, surrounds NDS' provision of conditional access services.

In response to the suit, NDS said the allegations are "without merit." The company also believes the suit is a pretext designed to enable DirecTV to "circumvent restrictions on DirecTV's future use of NDS' intellectual property." NDS said it will defend itself and plans to file counterclaims against DirecTV.

This is not the first time DirecTV has sued NDS. In December, DirecTV filed a suit alleging breach of contract. The suit, according to DirecTV, centered around two specific breeches of contract claims and is unrelated to its latest suit. NDS disagrees. The first lawsuit was dismissed in February, after the two companies reached a settlement.
